1. Service Provider

TrogirBoat is a trading name of Aetas Aurea d.o.o., a company registered in the Republic of Croatia (OIB: 10132796428), with its registered office in Split. All tours operate under Croatian maritime law and applicable EU regulations.

2. Booking and Confirmation

When you submit a booking request, you select one of three available rates: the Non-Refundable Rate, the Flexible Rate, or the Cash On-Site Rate. The selected rate determines both the price and the applicable cancellation terms. After we confirm availability, you will receive a secure payment link (powered by Stripe) by email. Your booking is confirmed once payment is completed via this link. Until payment is received, no binding contract exists between you and TrogirBoat. We reserve the right to decline any booking at our discretion.

3. Pricing and Payment

All tour prices are quoted in euros (EUR) and are per boat, not per person. Three rates are available for each tour:

Non-Refundable Rate: Full-day tours: €1,100. Sunset Tour: €550. This is the lowest available price. No cancellation is permitted once payment is completed. The full amount is charged at the time of booking via the secure payment link.

Flexible Rate: Full-day tours: €1,350. Sunset Tour: €700. This rate includes a flexibility surcharge (€250 for full-day tours, €150 for the Sunset Tour) that enables free cancellation up to 24 hours before departure. The full amount is charged at the time of booking via the secure payment link.

Cash On-Site Rate: The customer pays a deposit via the secure payment link to confirm the booking: €200 for full-day tours, €100 for the Sunset Tour. The remaining tour price is paid in cash on the day of the tour. The deposit is non-refundable and will be forfeited if the customer does not show up.

All payments are processed securely through Stripe. Accepted payment methods include credit card, debit card, Apple Pay, Google Pay, Klarna, and SEPA bank transfer. Fuel is not included in the tour price and is charged separately based on actual consumption (approximately €150 to €200). The estimated fuel cost is communicated at the time of booking.

The price differences between the rates reflect the commercial value of the respective cancellation and payment options and are not penalties or fees. The customer freely selects the rate that best suits their needs. In accordance with Article 56 of the Croatian Consumer Protection Act (OG 19/2022), the adequacy of the price is not subject to an unfairness assessment provided the terms are clear and comprehensible.

4. Cancellation by the Customer

As a leisure service provided on a specific date, this booking is exempt from the 14-day withdrawal right under Article 16(l) of EU Directive 2011/83/EU, transposed into Croatian law as Article 86(1)(12) of the Consumer Protection Act (OG 19/2022). The following contractual cancellation terms apply based on the rate selected at booking:

4.1 Non-Refundable Rate

No cancellation is permitted. If the customer does not attend the tour or cancels after booking, the full tour price remains due. No refund is given. This constitutes a binding contractual obligation accepted by the customer at the time of payment.

4.2 Flexible Rate

More than 24 hours before departure: The customer may cancel free of charge. Only the flexibility surcharge (€250 for full-day tours, €150 for the Sunset Tour) is retained by TrogirBoat. The base tour price is refunded within 7 business days to the original payment method via Stripe.

Less than 24 hours before departure or no-show: The full flexible rate is due. No refund is given.

4.3 Cash On-Site Rate

The deposit (€200 for full-day tours, €100 for the Sunset Tour) is non-refundable. If the customer does not show up, the deposit is forfeited. If the customer cancels in advance, the deposit remains with TrogirBoat; however, a reschedule to an alternative date may be offered at the discretion of TrogirBoat.

4.4 General provisions

All cancellation requests must be submitted in writing by email to book@trogirboat.com or via WhatsApp. The timestamp of the message determines whether the cancellation is within the permitted period. Refunds are processed via the original Stripe payment method.

5. Abuse Prevention

Each customer is entitled to one free cancellation per season. TrogirBoat reserves the right to decline bookings or refuse refunds where a pattern of repeated bookings and cancellations is detected from the same customer, email address, phone number, or payment method. This policy exists to prevent abuse of the booking system and to protect the availability of tours for all customers. All booking and payment transactions are logged and monitored.

6. Cancellation by TrogirBoat

If we cancel a tour due to weather conditions, mechanical issues, or any other reason within our control, you will be offered a free reschedule to an alternative date or a full refund of all payments made, including any processing fees. Weather-related cancellations are communicated by the evening before the scheduled departure.

7. Security Deposit

A refundable security deposit of €500 is required at check-in on the day of the tour. This may be paid by credit card hold or in cash. The deposit covers potential damage to the vessel caused by the guest. It is returned in full at the end of the tour provided no damage has occurred. Any damage beyond the deposit amount is covered by our hull insurance.

8. Guest Responsibilities

Guests must follow the skipper's safety instructions at all times. The skipper has the authority to adjust the route, shorten the tour, or return to port if conditions become unsafe or if guests behave in a manner that endangers themselves, other passengers, or the vessel. No refund is given in such circumstances. Guests under the influence of alcohol or drugs may be refused boarding without refund.

9. Liability

TrogirBoat carries professional liability insurance and hull insurance for the vessel. We are not liable for loss or damage to personal belongings brought on board. Guests participate in water activities (swimming, snorkelling) at their own risk. Children under 12 must wear life jackets while on deck.

10. Data Protection

Personal data collected during the booking process is used solely for the purpose of fulfilling your booking and communicating with you about your tour. Payment data is processed by Stripe, Inc. and is never stored on our servers. We do not share your data with third parties except as required for payment processing via Stripe. 11. Governing Law

These terms are governed by the laws of the Republic of Croatia. The following EU and Croatian regulations apply: EU Directive 2011/83/EU on consumer rights (in particular Article 16(l) regarding leisure services with a specific date of performance), the Croatian Consumer Protection Act (Zakon o zaštiti potrošača, OG 19/2022, in particular Articles 53 to 59 on unfair contract terms, Article 56 on price adequacy, and Article 86(1)(12) on the withdrawal exemption for leisure services), and EU Regulation 2016/679 (GDPR) on data protection. Any disputes arising from or relating to these terms shall be subject to the jurisdiction of the competent courts in Split, Croatia.
